I sold 3 small diamonds, buyer said he only rec'd 2 of them and they were fake and they were not fake (real diamonds).  He was rewarded his  money back from ebay and lied and said he only rec'd 2 of them and they were fake. How would that make you feel.  very mad and sad that people do this to other people. I could not  control myself.  Hurt that ebay would believe him and not me.  i don't cheat anyone out of anything.  I am still upset over this.

I sold 3 small diamonds, buyer said he only rec'd 2 of them and they were fake and they were not fake (real diamonds).  He was rewarded his  money back from ebay and lied and said he only rec'd 2 of them and they were fake. How would that make you feel.  very mad and sad that people do this to other people. I could not  control myself.  Hurt that ebay would believe him and not me.  i don't cheat anyone out of anything.  I am still upset over this.

As a seller, you need to have the buyer send you back the diamonds and give them a complete refund.

You may not be able to prove they received only 2 or the

3 loose diamonds. (How where they packaged up to prevent

the lose of one of them?) 

                                   OR

You can wait for them to file a dispute on this transaction.

All you can do then, if the buyer files a Item Not As Described claim, is show eBay your proof that the diamonds are real.

 

But, either way, you will need to refund for one of the diamonds if you win the case.

 

If you loose the case, you will be forced to refund once they return your diamonds.

I SO feel for you...I really feel bad that a buyer duped ebay, as almost usual...

 

Buyers seem to just throw sellers under the bus, at any whim...

 

I'm writhing in my own pain, currently, about a beautiful pair of boots, I sold. No contact from buyer, no return emails of my 2, asking for a return and I'll pay all return ship costs, no response to my phone call, grovelling...Just a bad Neg!

 

You have every right to feel anguish. WOW! I feel for you, You are not alone!!!!!

I feel really bad for you.  When Ebay makes a decision, it's he says, she says.  They do not have any way of telling who's telling the truth.  So they usually make the buyer return the item for a refund.  Did you at least get 2 of those diamonds back?  If not, you can try appealing the decision & say that the buyer did not return the items. 

 

When they opened a case, did you give your side of the story?  If you are able to appeal, give as much info as you can.  But don't call the buyer names, just give the facts.  Use any messages you got from them that may be helpful.  Did they leave you FB?  I saw one positive FB for 3 diamonds, was that from them?  Ask (in the appeal) why they left positive FB for 3 real diamonds.  Do you have an appraisal for the diamonds?  You can scan that & include it in the appeal to prove they're real.

 

If they left FB for you, respond to it saying buyer bought 3, only returned 2, beware!

 

If you got the 2 diamonds back, report the buyer for not returning what you sent to him.  That may not do any good, other than that Ebay will keep an eye on him for any pattern of filing false claims.

 

Did the seller send you pics at all of the envelope?  If you had insurance on it, try filing a claim with the post office for the "supposedly" missing diamond.  I too am interested in how you mailed them (box, envelope, etc.). 

 

You can also watch on Ebay, to see if someone is selling diamonds like yours.  If you suspect he is reselling it under a different name, you can call Ebay & ask them to check  if it's the same person.  They can't give you any personal info, but they can check if the name & address, or city are the same as your buyer.

 

It's a shame there are people like this & they are allowed to get away with it.  I'm sorry for you, but live & learn & try to get over it.  I know easier said than done, but please don't let it make you sick.
