Buyer made an offer, in the note section buyer types free ship, the offer page clearly states "Your Offer" (Shipping not included), buyer now threatins to bring it to an ebay complaint and refuses to pay the shipping, can I relist the item.

Buyer made an offer, in the note section buyer types free ship, the offer page clearly states "Your Offer" (Shipping not included), buyer now threatins to bring it to an ebay complaint and refuses to pay the shipping, can I relist the item.

You wait four days, if they don't pay, you open the unpaid item report, close it four days later if still unpaid, close the dispute and THEN relist.

 

You are correct, best offers is for the item price only; shipping if listed, is not part of the offer.

But is IS part of the offer IF the buyer made note of it and the seller accepted it as FREE SHIPPING!

 

So the seller is obligated to ship free since that is what he accepted in the offer.

NO IT IS NOT,

 

Shipping is NOT negotiable, The amount offered in a best offer is the item price ONLY.

He can't report you because the BO says shipping not included.  However, you should have countered at his price plus shipping, or just messaged him that he would have to pay shipping.  Although not really your fault, there was enough room for error by you accepting it with his notes for free shipping.

 

If it were me, I would bite the bullet & ship it for free at his offer, then add him to my BBL (blocked buyers list).  You have to decide if the shipping cost is worth the risk of neg. FB.

 

You can open a UPI if he doesn't pay, but his logic is you accepted his offer with his note.  So if he pays to avoid the strike, you can be certain to get neg. FB.  He's already upset that you are trying to charge shipping when he thought it was free. 

 

If you choose to ship it to him with free shipping, you can difuse his anger & get him back on your side by sending a message saying there was a miscommunication, but to keep him a happy customer, you will ship for free. 

 

It's possible you are going to get neg. FB no matter what you do.

 

And you can never relist an item until to complete the first transaction, by either shipping, opening a UPI or sending a cancellation.

I can see both sides of this discussion.  If you read everything that is written about BO, it says that a seller cannot use auto respond if the buyer puts in terms.

 

That would make you believe that those terms become part of the offer(contract).  Since this buyer did and the seller accepted then one would think it overrides the generic "item only" clause.

 

I would like to hear an official ruling on this because I really think the seller needs to ship it free.

 

Regardless what WE think the buyer thinks it needs to be shipped free.  As a previous poster said I would ship it free just to provide good CS and to protect my DSR's!

For listings in which the seller has specified shipping costs for the item, the Best Offer price includes only the listed item. For listings in which the shipping costs aren't specified, the buyer can choose to include shipping costs in their offer.
