Now I got an email saying there's a case opened about not paying. I did not want to buy the phone and I emailed the seller right after I made that mistake. What do I do? I don't want my account to be suspended.

If the seller would have accepted your offer ... you would still have to pay for it.

 

YOU pressed to"Confirm" button twice and it stated on that same page that you "commited" to paying for your item should you win.

 

 

Now you can pay for it and

  list it for sale on Ebay if you would like.

If the seller is not responding to your messages and instead has filed an unpaid item claim, then it sounds to me like they are not receptive to cancelling the transaction.  If you don't pay, you will get a strike on your record that will last for one year.  If you get a second strike, you will be blocked by many seller's from buying their items on ebay.
