I purchased a pair of Hudson jeans and they turned out to be fakes.  I contacted the seller and he agreed to take them back.  Do I need to file a dispute so I can make sure I get my money back?

No, that would be unfair to the seller, who is trying to be helpful. You have 45 days from the date of payment to get eBay involved, but if you do it is a black mark on the seller's record.

Good.

Make sure that agreement is in your eBay My Messages, just in case you need it later.

 

Return the item as instructed by the seller.  Make sure you have appropriate Delivery Confirmation for the return.

 

The seller should refund you soon after receiving the returned item.  If they do not, THEN is the time to file the "Not As Described" case at eBay.  Remember, though, do not let the seller delay you past the 45 day limit for such filing!

Do not open a dispute unless the seller stops cooperating.

And be sure to send the jeans back with delivery confirmation, so that you can  show online that they have been received.

Does the seller have to wait for my funds to clear before issuing me a refund?  He has told me he has money problems.
