When is it best to report fraudulent activitity but still preserve my right to leave bad feedback?

If a seller lists an item identical to what he was supposed to send to me the day after he ships me a similiar item but without the added features of the item I purchased, when do I report the transaction as fraudlent.  I want to find a way to leave bad feedback, but  have to notify PayPal and Ebay as I never heard from him when I emailed him that I refused the inferior item when it was delivered.  I did tell him in an email that I knew he  listed the superior item again for $80 more than I paid.  Nothing from him in two days but gave him three to make it right.  Any advice of the best timing given this situation.

Contact the seller telling him the item was not as described and see if he will make it right. If he refuses, file a case "item not as described" in the resolution center (top right of page under customer service). This will give him another chance to make it right. If that dosn't happen, escalate the case to ebay customer support. They will tell you to return the item at your cost(make SURE to get tracking and delivery confirmation), and will force the seller to refund the item cost and original postage.

 

Then you can still leave any feedback you wish along with the dsr's that are applicable.

The seller is allowed to list whatever he wants as long as he has the item to complete the transaction.

There is nothing fraudulent about that at all.

 

His other listings have nothing to do with yours.

 

 

If your listing was not as described then that is your only issue with this seller and eBay has provided you with the steps to resolve problems and buyer protection.

You need to watch how you are handing this as it is you that can be reported for sending the seller nasty messages about things that have nothing to do with your transaction...such as his other listings.

 

If you refused the item...then as per policy you will not get a refund. You are required to have in writing in your messages permission from the seller to return the item or from eBay as part of a dispute.

 

It sounds like you are being your own worst enemy here.

If the seller does not respond ,  just file a case as "item not as described "     do not wait to long to do it 

You then return the package to the seller,  but be sure you have proof of delivery when you returned, after that the seller will have to return your money, including your shipment . 

 

when  seller does not responde  to claims , is always  E-Bay  buyers protection .

Is it not as described?

 

Take the advice you got above.

 

And remind me never to sell you anything.  You sound dangerous.  ;)

 

 

P.S.  Even if the item turns out to be not as described, it isn't necessarily a matter of fraud.  People make mistakes, and most of us want a chance to correct the mistakes we make.

You handled that ALL WRONG. Yes you did email the Seller as you said but you didn't follow eBays policy for returning an item.

 

Returns have to be returned with Delivery Confirmation/Tracking to prove it was returned. You never opened the package - How do you know what it looked like?

 

If you open a dispute for item not as described, you will loose. All the Seller has to do is tell eBay what has happened here and find out that you didn't even see the actual item. You just assumed.

 

It is possible that the Seller will do the right thing and give you a refund. Probably only if you do the right thing and agree to cancel the transaction so that they may get their Fees back on this unwanted item. You are playing by your rules and not following policies.

Thinking about how you are going to hurt the Seller by using feed back manipulation is also against eBay policy and may get you NARU depending on what they decided.

I am sure that everyone has ran to their Blocked Bidder List after reading this.
