What can I do when I seriously suspect that I've been a victim of a fraud (seller not sending item) but have no chance of opening a case because the moment I noticed fraud excedeed eBay policy timing?? Am I now on my own without any chance of defense?? Thanks.

Yes, unless you can call your credit card company and do a chargeback.

Why did you wait so long?

First try and file a case. You have 45 days to the last second. If you can'r and paid bt credit card, you card company may help.
