My repeat buyer has not paid (4 days ended tonight at 8:30 PST) & I think I want to keep the item.  I should have blocked her as I didn't want to deal with her again as she was late with the last payments.  I have blocked her for future sales.  Now here is the craziness....do I have to make contact with her or even have to file an unpaid claim as I have decided to keep the item rather then relist it again?  I know I will lose listing fee but it is worth it to me.  I don't want to damage my feedback, am I taking a bad risk?  Do I have to give her 8 days to pay?

File NOW.  Don't bypass the rules just because you are unhappy.  And if she pays you must ship.

do I have to make contact with her or even have to file an unpaid claim

Yes.

If you do not close out the transaction, the buyer could pay you at any time.

If you want your Final Value Fees refunded, and the ability to make a Second Chance Offer, or relist correctly,  or have the possibility of keeping the item, you must do one of the following:

1. Complete the Unpaid Item process  (usually preferred)

 or

2. Convince the buyer to agree to a Cancellation Request,

Both options are available in the eBay Resolution Center

Here is a comparison of the timelines, pros, and cons of filing an Unpaid Item (UPI) report versus a Cancellation Request (CR)

Also consider putting the bad  bidder on your Blocked Bidders List.  (Stop back here for more information if you need to learn how to do that).

There is no rule that you must file an unpaid item dispute if the buyer doesn't pay, though there is a rule that says you must send it to her if she pays.

Thus, IMHO your best option is to just sit tight and wait. If she never pays for it, it's yours to keep.

@bostongrammy...what if the buyer waits a mnoth and a half and pays? It could happen.

If you don't file a UPI case or at least offer to cancel, you will definitely lose the final value fee, and as you have already blocked her from buying again, what's the point of waiting?

If you keep the item laying around and something happens to it, and the buyer waits an entire 59 days before paying, you  are STILL liable to ship the item as described. Darned if I would eat a fvf for a deadbeat buyer!

If you are worried about feedback as you say, send her a note about the UPI being automatic. If the case closes without payment, she is blocked from leaving feedback anyway.

Thank you all so much for all your help.  I did file a UPI and it does say that the buyer has up to 4 days to pay you after the case is open.  If she does pay within the 4 days, I will send it to her as I would never be dishonest with a customer but let's hope she doesn't cause the item will look so cute with my Dept. 56 North Pole houses.......:)
