buyer asked for extended time to pay which I had to problem with. It has now been one month, no payment, no communication but I see they are paying for lots of recent purchases

You mean you filed UPI? Yes, you have to do something.
"If the buyer doesn't pay, you need to manually close the case in the Resolution Center within 36 days after the listing ended. If you haven't closed the case on the 37th day after the listing ended, eBay automatically closes it and you don't receive a final value fee credit. Also, an unpaid item won't be recorded on the buyer's account."

I have already opened a complaint in the resolution center on 2/8/2013....says I have to wait until 2/12/13 before I can close it. (which is today but it will not let me close). I have emailed the buyer and never heard back. I see she is paying other people. I don't mind relisting but I think she should be able to receive negative feedback...

You close it at the same time you opened it - 4 days later. And it's against ebay policy to give the buyer a negative - you can't even make a negative comment in feedback to a buyer. You could be reported and the feedback removed. When you close the UPI they will get a strike on their record. If they get 2 or more strikes they will be blocked by many seller's on ebay for a year.
