Yes.  I had a case that I was settling on the phone and he put me on hold to look over all the emails, his and mine.

Only if they are in the dispute console.  Ebay won't take the time otherwise.  They often never actually 'look' at a dispute, because it's an automated process.  

A seller has to prove an item arrived with online tracking for Item Not Received.

A seller has to accept an item for return if it's Not as Described, unless the item specifics chosen were 'for parts or repair.'

Ebay WILL step in sometimes over shipping large items back that cost a lot to ship.

What is your situation?

My situation is VERY simple - I saw - I bought (thru PayPal instantly) - this "clown" says he shipped 11/13 (no tracking or proof) - 10 days later still NO item - contacted seller again - seller now says shipped 11/26 (again NO tracking or proof) - today is 12/08 - still NO item and NO responce from seller to the case I opened. Looking for a refund or item - either way is fine with me - seller obviously has "issues". Thanks for your responce.

Basic INR which you will win automatically.  Escalate as soon as the dispute lets you, if necessary.  Leave negative with no mention of dispute or ebay will remove it.
