Has this not happened to anyone else?  I bought a cute swim suit through BIN.  It was mailed first class with delivery confirmation.  When I tracked it, it showed it was already delivered!  But I did not receive it and I was home on the day and time of delivery.  I called the local post office.  They made attempts to trace it but could not recover it.  The item was not insured.  I tried to use eBay resolution center but can not open a case because the item shows it was already delivered.  Contacted Ebay through chat and rep said to reach seller.  Seller said to go back to USPS since she already shipped item. USPS says they're human and someone is bound to make mistakes.  Supe let me file a claim even if it was not insured but cannot guarantee that my costs will be or when it will be refunded.

Something is wrong here.  Am mad at USPS of course, how can someone mark an item "delivered" then misplace it and have my other mail pieces dropped in alright?  But why does eBay consider the "Delivered ..." status a definite confirmation that the buyer has received the item - so much so that they won't even allow a case to be opened?  Isn't this where the eBay Buyer Protection (EBP) policy come in?  Or does the EBP only work when eBay can make seller pay (which obviously not in this case)?  Then eBay cannot claim it as its own or it should be noted as eBay Sellers Protection coverage. 

Meanwhile, I just lost a transaction and I couldn't get any help to rectify the situation.  Any suggestions?

The only person who can help you is your post office.  Go back and talk to the postmaster and tell them the item was delivered to the wrong address and you would like your item.  This is his/her job.  Don't talk to any clerk, only the postmaster.

 

And yes, they are required to find out what went wrong and, if you are forcefull enough, may even refund you.

You have no ground to file an Item Not Received dispute.

 

If the seller shipped to the address you have on record with PayPal and Delivery Confirmation shows it as being delivered, the seller is not responsible for your letter carrier's misdirection of the package.

 

Many people "think" that both eBay and PayPal Purchase Protection actually pay out claims from some sort of "petty cash" fund.  That is not the case.  In any dispute/claim if the seller is found at fault, they "force' the seller to refund.  In other words, eBay and PayPal will actually take the money back from the seller via the "Reimbursement Method" they have on record in order to refund the buyer.  

 

In your case, it is obvious the loss of the package was not the seller's fault.  Hence, you would lose the claim.

 

The only thing you can do is ask your children, spouse, roommate, neighbor, if they saw the package and happened to take it in the house.  Or, have a very long and serious talk with your Postmaster about your mail being delivered to someone else.

I meant to reply to 78blizzard not to respond "yes" to the question of whether his comment resolved my query.  How do I do that btw?

 

Let's forget about the procedurals in eBay, for a moment.  Why don't I have a ground to open a case for Item Not Received when I have not, in fact, received the item?

 

And as a buyer being greeted with this huge hype from eBay everytime you login that every purchase is guaranteed - item, shipping & all, why can't I rely and make them fulfill on that promise?

 

You will notice that I have not blamed the seller for this nondelivery - although maybe she could be more sympathetic to my situation.  I've already done the long conversation w/ supervisor at local post office.  None in my small family has gotten the package nor my neighbors, else they would have turned it in already.  This might even be a case of theft - as the mail carrier in question is not one of my regular delivery guys (who make sure to bring my packages to me).  Why is it that all the effort to get my item, rest solely on me.  Doesn't this situation call for Ebay to deliver on their promise of guaranteed delivery using their own funds (as any assurance "guarantor" would) without requiring the seller to pay up since she did her part?  If not, then there is clearly a misrepresentation in this entire EBP propaganda.

Hey, blizzard was completely correct with her advice. Neither eBay nor your Seller are responsible here. Your Seller purchased DC-it shows as delivered. Therefore the problem lies within your local postal service. You will have to follow thru on this with them. Good Luck.

Hi. mg. The reason you would not be able to file an INR is once you did and the seller put the DC number in the dispute console you would lose right then and there. I will have to agree with the other responders. I would take it up again with the PO. Remember, " the squeaky wheel gets the grease ". I have had this happen 1 time about 5 years ago and I was pi$$ed but come to find out later some little punk was going around stealing ppl's mail. I hope it shows up and I'am glad that you are not blaming the seller because they did what they were supposed to.    good luck.

It is possible that the item was indeed taken from your doorstep..Not out of the realm of possibility...

Oh, please. What should the seller have done? shoould they have said: Your business is very important to us. I am sorry this happened to you, here, I will refund your money?

Hi mgrumo,

 

I'm so sorry to hear that this has happened to you.  Although I think we can all understand your disappointment and frustration with eBay's Buyer Protection program right now, it doesn't solve your problem, which is trying to locate your package.

 

I had a similar thing happen to me, though it was not a package per se that was misdelivered.  It turns out that there is a house number that is the same as ours, only it is one street away, so it's on the correct route, just put into the wrong box.  We were fortunate in that the neighbor (who we don't know) put a post-it note on it telling the mailperson that it was delivered to the wrong address. I can't help but wonder if a similar thing has happened in your situation. Perhaps you can persuade the Postmaster to take another deeper look into your situation.

 

Also, if someone stole your mail, then this is a federal crime and the Post Office has inspectors who should be able to look into this.  If the mail was misdirected, misdelivered, or whatever they want to call this, they should have an investigator look into it.  You may also want to to with your local police department.  They may be able to assist you in some way.
