The package is torn and empty. Can I get a refund? Do I fight with the post office? Is it the sellers responsibility? Am I just out the money for my purchase?

Contact the seller and let them know what happened.  If the item was insured, they will want you to cooperate with an insurance claim.  If it wasn't insured, the seller is responsible for giving you a full refund.  They might request pictures of the packaging.  If the seller is not helpful, file an Item Not as Described dispute with Ebay.  You have up to 45 days from date of payment to do so.  Do not file an Item Not Received dispute since you did receive something...it was just an empty package.

No item then you talk to the seller and maybe file a dispute.

 

First tell the seller.  If you do not get response by Monday morning:

 

Go to My Ebay and to the item.  At the end of the line is a drop down box,  Find resolve a problem and click on it.

 

When the choices come up ONLY choose my item is not as described.  NEVER choose I did not receive my item.  That option will make you lose.

 

After you choose my item is  not received as described it will have you pick the item out and open the dispute.

Sounds like you managed to become a buyer on ebay without noticing or reading all the info about eBay Buyer Protection.

 

Contact the seller, tell them what happened, they will most likely send you an immediate refund, will probably ask you to send a picture of the package first.

 

If you are not satisfied with the response from the seller, go to the Resolution Center, you can find it under the Customer Support tab on the top right of most ebay pages and enter a item not as described claim. Be careful, DO NOT ENTER AN ITEM NOT RECEIVED CLAIM since you did receive something, the problem is not that you did not receive your item, the problem is that what you received does not match the item description. If you enter an item not received claim you will not be reimbursed as that is not true, you did receive something and the seller has proof that you did.


Wish my fingers would pay closer attention to what I spell correctly.
