Customer purchased a phone I had listed as no returns. Can he open a case and win it?

He has had the phone for almost a month. He says he's been having issues with audio on video recordings however all the other functions work correctly. I offered him a refund with a restocking fee even tho it was listed as no refunds. Just to keep customer satisfaction. Could he open a case and win against me?

Yes, buyers have 45-days to file the item not as described report.

 

You can't charge  restocking fee on an item that is not as described.

yes a buyer has 45 days to return if a case is opened they will definatly win

Yes. If the the buyer opens a case and ebay decides in their favor, they will be directed to return the item to you and then charge you for the refund.

 

As-Is and No Returns in your listing have no standing.

 

It's outlined in the User Agreement you agreed to when selling on ebay.


Know these 4 things:
1) Buyer Protection - 45 days to file a claim
2) Auctions are binding contracts
3) Click on Customer Support to find all answers
4) Problems are resolved in the Resolution Center

Yes, he can, and you can't charge him a restocking fee unless you specifically stated that on the listing.

 

Sellers who sell with a no returns policy risk the possibility, or probability, that the customer will go straight to the resolution center with their problem. They usually feel that since the seller doesn't accept returns, there's no need in trying to contact them if there is a problem.

 

They will be told to return the item, at their cost, for a refund. You would then be required to refund their original cost plus shipping.

 

It's much better to offer a return policy, and try to work these problems out among yourselves without involving eBay.
