Seller described unit as being in perfect cosmetic condition and when the item arrived it was heavily scratched, had paint drippings on it and heavy black smear marks that would not come off.Seller is stating I am responsible for sending the item back to him. This is not stated in the auction.

A good seller would pay the return shipping in this case. The requirement though is that the buyer pays return shipping.

If you file a dispute wth ebay and win the dispute they will require you ship the item back to the seller at your expense to secure a full refund.

You will have to pay for the return shipping, BUT the seller may reimburse you since they did not describe the item properly. It wouldn't hurt to ask.

When you do ship the item back to the seller [ at YOUR expense ] make sure that you use "Delivery Confirmation"  OR "Signature Confirmation" if $250.00 or more so that you're covered by "online" proof of delivery. After the seller receives the item back, they should refund the cost of the item PLUS the initial shipping. B-)
