Opening a dispute after the listing was deleted by eBay.

Hi everyone.

Yesterday I bought an item on eBay which turned out to be a wholesale *list*. eBay deleted the listing a couple of hours later (after I had payed the seller) and the seller's page on eBay now says: "No longer a registered user". The seller didn't include a shipping arrival date on the listing either, so I do not intend to wait.

After e-mailing Paypal (since I'm outside of the US and I can't call them), and telling them that the listing was a scam (a wholesale list, not posted in the Classified Ads section, a 1 day listing, seller not replying, not even marking the item as shipped, etc.) and telling them that even eBay had deleted the listing, I got a reply from Paypal today:

"Hello!

I can see that the payment has been held and a case reference PP-002-152-086-933 has been created on PayPal.

Please log in to the resolution centre and follow the steps that have been outlined. Hopefully we will be able to bring the matter to a satisfactory conclusion for you.

I hope the issue is resolved soon."

I'm glad that I got this kind of reply, but should I open a dispute on eBay or Paypal? eBay's buyer protection says that you can complain about an item after it has arrived, but I've not received it yet. Paypal has a dispute type that you can open without waiting for the item to arrive, should I follow that route? I have payed with Paypal and have done everything in the normal way.

What would you suggest doing?

BTW, I just checked on the resolution centre on Paypal, and there was a case opened by them, I guess I have to follow that, right?

It just says that the case has been opening, and the status is: "Waiting for seller's response".

Is there anything I can do here or should I wait for the seller to reply?

I remember your previous posts

You have TWO cases that you can open on ebay:

Item NOT received

Item NOT as described

You CANNOT open either one yet.  It is TOO early for either to be opened on ebay, and I believe if you were to even try, you would NOT be able to.

You will have to wait for paypals decision.

The following is from paypals help section:

Ineligible Items. PayPal Buyer Protection only applies to PayPal payments for certain tangible, physical goods. Payments for the following are not eligible for reimbursement under PayPal Buyer Protection:

Intangible items, including Digital Goods

I know you are anxious to push things along but there is a process to these disputes.............

You rushed to purchase this item and then got yourself into a jam, and now you want to rush the process to have it resolved..........Slow down and wait for the next step.

I know, thanks for your replies and for the help.

I have been as honest as possible with Paypal and gave them the whole information that I know, and they're aware that it was sold as a list and how the listing violates eBay's policy, so hopefully they will take that into consideration.

I just hope they wont wait for like a week for the seller to reply...

Thank you!

10 days? But the seller is NARU, aren't they aware of the fact that he can't reply?

Thanks anyways.

PP will email the seller at their home email to get a response

If they don't reply,you get a refund

and the former seller's account is deducted that $ amount
